Terms and Conditions

As follows, we would like to introduce to you our terms and conditions, which we use to process your purchase.

Contract and deliveries

By clicking on the button "buy now" you place a binding order for the articles in the shopping cart. We will confirm the receipt of your order directly by email after you placed the order. A binding contract is concluded upon receipt of the order confirmation. Please note when paying in advance (reservation), that the delivery of the ordered goods is made as soon as we received the payment of the full purchase price and any shipping costs. Therefore, we ask you to transfer the purchase price immediately after the receipt of the order confirmation or within 5 days.

Please note that, exceptionally, we are not obliged to deliver the ordered goods if we have ordered the goods properly on our part but have not been supplied correctly or on time (congruent hedging transaction). A further requirement is that we did not cause the lack of availability of goods and have informed you of this fact without delay. In addition, we must not have assumed the risk of obtaining the ordered goods. If the goods are unavailable, we will refund you immediately for any payments that are already made.

We do not assume the risk of having to procure ordered goods (procurement risk). This applies as well to the ordering of goods, which is described only by their nature and their characteristics (generic goods). We are only obliged to deliver from our stock of goods and the goods we order from our suppliers. If working days are indicated as deadlines, hereunder we understand all days from Monday to and including Friday, with the exception of public holidays.

You will be informed about the delivery time on the product detail page as well as before placing the order.

Prices and shipping costs

The prices listed in the offer at the time of the order apply. The prices quoted are final prices and include the German VAT. Until the full payment of the purchase price, the goods remain in our property.

We offer shipping with DHL from EUR 5.00 for all orders in Germany. Outside of Germany we offer shipping with DHL from EUR 10.00. Any costs of a return or an exchange are to be borne by you.

Payment

Basically, we offer the payment methods cash, prepayment, credit card, Apple Pay, Google Pay and Paypal. We reserve us the right to reject a payment method and refer to other payment methods. Any costs of a money transaction must be borne by you.

If the payment is done by credit card, the time of debiting your credit card is our order confirmation.

We reserve us the right to charge overdue fines with an amount of 5 EUR per reminder, if you are in default of payment. You will be able to prove that the damage has been substantially less than 5 EUR or no damage at all.

You agree to receive invoices and credit notes in electronic form only.

Promotional vouchers and redemption

Promotional vouchers are vouchers that can not be purchased, but which we issue as part of advertising campaigns with a specific period of validity.

Promotional vouchers are only redeemable in the specified period and only once as part of an order process. Promotional vouchers can not be used to purchase gift cards. Please note that promotional vouchers may be tied to a minimum order value.

The value of the promotional voucher must equal at least the value of the purchase price. A possible balance can be paid with the offered payment methods. A promotional voucher can not be paid out or receive any interest. The promotional voucher can not be refunded if goods are returned in whole or partially.

Promotional vouchers can only be redeemed before completing the order process. Subsequent crediting is not possible. The promotional voucher can not be transferred to third parties. Several promotional vouchers can not be combined unless we have agreed.

If you have used a promotional voucher with your purchase, we reserve us the right to charge you the original price of the goods you keep, if - due to your cancellation - the total value of the order falls below the value of the promotional voucher or equals it.

Gift cards and redemption

Gift Vouchers are vouchers that you can purchase. These can only be redeemed for the purchase of AVE products, but not for the purchase of additional gift cards. If the credit balance of a gift card is insufficient for the order, the balance can be paid with the offered payment methods.

Gift cards and credits can only be redeemed before completing the order process. A gift card can not be paid out or receive any interest.

Right of revocation

Informations

You have the right to revoke from this contract within fourteen days without giving any reason. The revocation period is fourteen days from the date which you, or the third party you named (who is not the carrier), took possession of the goods. To perform your right of revocation, you must inform AVE GmbH, Grashofweg 11b, 21698 Harsefeld, Phone: +49 (0) 171 737 60 26, E-Mail: info@ave-equestrian.com by means of a clear statement (eg letter or e-mail) about your decision to revoke from your contract. You can use the attached example revocation form. This is not mandatory.

If you perform a revocation, we will immediately send you (for example by email) a confirmation of your cancellation. In order to maintain the revocation period, it is sufficient that you send us a notice, that you want to use your right of revocation before the revocation period expires.

Consequences of revocation

If you revoke from this contract, we will refund your payment within fourteen days (including standard delivery charges), from the day, which the notification of your revocation has reached us. Therefor we will use the same payment method you used in the original transaction, unless we have a different agreement with you. In no case you will be charged with repayment fees. We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to us immediately and in any case not later than fourteen days from the date, which the notification of your revocation has reached us .

The deadline is met, if you send back the goods before the period of fourteen days has expired. We will pay the costs of returning the goods, if you use the return label provided by us (for returns within Germany). Otherwise the return costs are to be borne by you.

You only must pay for any loss of value of the goods, if this loss of value is due to an improper examination of the nature, characteristics and functioning of the goods.

End of the information about right of revocation

Attention: The right of revocation expires prematurely in contracts for the delivery of sealed goods, which are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery.

Refund

We will automatically refund the balance to the account you have used for payment. When paying in advance, the refund will be directed to the account from which the transfer was made. If you have paid via Apple Pay, Google Pay or Paypal, the refund will be made to the associated account. If you have used a gift card with your purchase, we will credit you with the corresponding amount on your gift card.

Liability for defect and further informations

The statutory liability for defects applies.

In addition, you can print or save this document by using the usual function of your Internet service program (= Browser: usually "File" -> "Save As"). You can also download and archive this document in PDF format by clicking here. To open the PDF file you will need the free program Adobe Reader (at www.adobe.com) or comparable programs that can handle the PDF format.

You can simply save our terms and conditions of your order by either downloading the terms and conditions or storing the data summarized on the last page of the ordering process in our shop using the functions of your browser or you wait for the automatic order confirmation that we provide additionally by email after completing your order to the email address provided by you.

This order confirmation email contains once more the data of your order as well as our terms and conditions and can be easily printed or saved with your email program.

The European Commission provides an online dispute resolution (OS) platform, which can be found at the link to the European Commission's platform. We are not obligated and unwilling to participate in a dispute settlement procedure in front of a consumer arbitration board.
